The DuPage County Circuit Clerk's office is a constitutional office. The clerk is elected every four years by DuPage County voters. State law and the Illinois Supreme Court set the duties of the office. By law, the clerk must establish, keep, and maintain all court records and the court seal. All records that are not sealed or impounded by a court order are open to the public during business hours.

For name searches, you must enter both the first and last name. The system shows defendant names along with birth years in the public index. This is one of the more accessible online tools among Illinois counties for finding felony case information.

Keep in mind that the online system has limits. It may suspend access if too many lookups come from the same IP address. Sentencing details are not shown in the online portal. Fees for DuPage County Felony Records

Copy fees follow the standard Illinois schedule. The first page costs $2.00. Pages two through twenty are $0.50 each. Pages twenty-one and up are $0.25 each. Document certification is $6.00 per seal. In-person payments can be made with cashier's check, money order, or cash. The clerk's office does not take personal checks for record copies.

DuPage County Felony Case Laws

Illinois law governs how felony records work in DuPage County. The Criminal Identification Act (20 ILCS 2630) requires all law enforcement in the county to submit fingerprints and arrest data for felony arrests to the ISP Bureau of Identification. Under the Uniform Conviction Information Act (20 ILCS 2635), anyone can request a name-based conviction search through the state police. This returns only conviction data, not full arrest records.

The Unified Code of Corrections (730 ILCS 5) sets sentencing ranges for felony classes in Illinois. These apply to every DuPage County felony case. Class X carries 6 to 30 years. Class 1 is 4 to 15. Class 2 is 3 to 7 years. Class 3 is 2 to 5, and Class 4 is 1 to 3 years.

DuPage County felony records that qualify may be expunged or sealed. Not all convictions are eligible. Filing the petition is free, but the ISP charges $60 to process the court order. The Illinois FOIA (5 ILCS 140) allows public records requests from law enforcement agencies but does not cover court records directly.
