Winnebago County Felony Record Fees

Copy fees are the same as most Illinois counties. First page: $2.00. Pages two through twenty: $0.50 each. Pages past twenty: $0.25 each. Certification is $6.00 per seal. If the clerk needs to search for a case without a number, a $6.00 research fee applies.

Winnebago County also has a Drug Court program for nonviolent felony defendants with substance abuse issues. Records from Drug Court cases are part of the county felony record system and subject to the same access rules.

Felony Record Laws in Winnebago County

Every law enforcement agency in Winnebago County must report felony arrest data to the ISP under the Criminal Identification Act (20 ILCS 2630). This feeds the statewide criminal history database. The Uniform Conviction Information Act allows name-based searches for $10 electronically. Only conviction records are returned.

Sentencing follows the Unified Code of Corrections (730 ILCS 5). Winnebago County felony cases get the same class structure as the rest of Illinois. Class X is 6 to 30 years. Class 1 is 4 to 15 years. Class 4 is 1 to 3 years. The class listed on the felony record tells you the severity of the charge.

Some Winnebago County felony records can be expunged or sealed. You file a petition with the 17th Circuit Court. Class 3 and Class 4 convictions may qualify for sealing. The ISP charges $60 to process the order. Under the Illinois FOIA (5 ILCS 140), the Rockford Police Department and the Winnebago County Sheriff process FOIA requests for arrest and incident reports. Courts are exempt.
